These Terms of Service (the "Terms") govern your access to and use of Shuriken Stats (the "Service"), operated by Kaizen Advantage Inc. ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Shuriken Stats is a browser-based toolkit for Six Sigma and Lean / Continuous Improvement work, including planning tools and statistical analysis modules. The Service is provided over the internet and runs in your web browser. We may add, change, or remove features over time.
To use most features you must create an account. Account creation and sign-in are handled by our authentication provider. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. You must be at least the age of majority in your jurisdiction, or have the consent of a parent or guardian, to use the Service.
Payments are processed by our third-party payment processor. We do not store your full card details.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with or disrupt the Service; (d) reverse engineer, copy, or resell the Service except as permitted by law; or (e) share, sublicense, or resell access to your account.
You retain all rights to the data and content you create or upload while using the Service. As described in our Privacy Policy, analysis runs in your browser and your process data is not uploaded to or stored by us. You are responsible for keeping your own backups of any project files you create.
The Service, including its software, design, text, and branding, is owned by Kaizen Advantage Inc. and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No rights are granted except as expressly stated.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete.
To the maximum extent permitted by law, Kaizen Advantage Inc. and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or a notice in the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws rules. The courts located in the Province of Alberta, Canada will have exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.
